| Rules of the Sectional Title Scheme |

From the date that the body corporate is established, every sectional scheme is subject to rules for the control and administration of the scheme. Under the current Sectional Titles Act, these rules are known as Management Rules and Conduct rules, prescribed in Annexures 8 and 9 of the Act. It is important for owners to be aware of the hierarchy of Sectional Title. Conduct rules may not be in conflict with management rules, and neither set of rules can conflict with the Act itself. The body corporate can amend both sets of rules by the process described in the next section, but it may not make a rule that would go against a provision of the Act. This prevents a body corporate pushing through by means of a special resolution an amendment that requires unanimity or goes against the Act itself. |
